The Judiciary in the 1990s: guardian of the welfare state?

During the 1990s there have been indications that a number of senior judges are concerned to protect and preserve the principles upon which the UK welfare state is based. In addition, they see a correlation between welfare provisions and fundamental human rights and, in some instances, view a withdrawal of these provisions as an infringement of human rights. This article examines judicial attitudes in cases which have raised benefit, health and education issues and suggests that the incorporation of the European Convention on Human Rights may have the effect of increasing the role of the judiciary as guardian of the welfare state.

Durante los años noventa ha habido indicaciones de que algunos jueces consideran necesario proteger y preservar los principios que están a fa base del sistema de bienestar social. Estos jueces yen una correlación entre las provisiones sociales para el bienestar y los derechos humanos fundamentales y en algunos cas os, yen el retiro de estas provisiones como una violación de los derechos humanos. Este articulo examina las actitudes judiciafes en casos en que se ha Ilamado la atención sobre subsidios y asuntos educativos y de salud. Sugiere también que la incorporación de la Convención Europea sobre Derechos Humanos podría aumentar el papel que tiene el sistema judicial como guardián del estado benefactor.

Au cours des années quatre-vingt-dix, certains magistrats supérieurs ont montré leur attachement à la sauvegarde des principes sur lesquels repose l'Etat-providence. En outre, ils voient une corrélation entre les prestations sociales et les droits fondamentaux de l'homme et, dans certains exemples, considèrent le retrait de ces prestations comme une atteinte aux droits de l'homme. Cet article examine l'attitude des juges dans les affaires portant sur la question des allocations, de la santé et de l'éducation et suggère que l'incorporation de la Convention Européenne des Droits de l'Homme pourrait avoir pour effet d'augmenter le rôle du pouvoir judiciaire comme gardien de l'Etat-providence.
