Abstract:

Fort Wayne's wet weather long term control planning efforts and negotiations largely concluded with a consent decree with the United States' Environmental Protection Agency (“EPA”) Region V and the Department of Justice that became effective April 1, 2008. Typical issues of technical approach, level of control and program duration were resolved in the negotiations. This document will overview Fort Wayne's sewer system, provide information on Fort Wayne's current regulatory situation and provide an outline of Fort Wayne's overall Long Term Control Plan (LTCP) strategy and the general approaches Fort Wayne will utilize to meet the consent decree requirements. Additional points include a summary of its primary consent decree provisions, anticipated challenges and goals of its wet weather program and a reflective look back at key negotiation issues from Fort Wayne's perspective.
