Abstract:

To meet stringent whole effluent toxicity limitations at the Morris Forman wastewater treatment plant (MFWTP), Louisville-Jefferson County Metropolitan Sewer District (MSD) developed plans to construct a multi-port diffuser in the Ohio River. A citizen group (Sierra Club) took exception to this plan and filed a lawsuit against MSD and the Regulatory Authority, the Kentucky Division of Water (DOW). As a result of the lawsuit, an agreed order was negotiated that laid out a plan to resolve each party's differences. The agreed order called for the formation of an Environmental Leadership Committee (ELC) whose charge was to recommend additional pollution prevention activities to assist MSD in achieving the goal of no acute effluent toxicity. The objective of all partners (MSD, DOW, and the Sierra Club) was to research, develop, and implement pollution prevention measures to bring the Morris Forman wastewater treatment plant into compliance with its whole effluent toxicity limitation 1.0 TUa without the installation of a multi-port diffuser.
