Abstract:

This paper summarises important recent developments in merger law and policy in OECD countries, based on information submitted to the OECD’s Competition Law and Policy Committee in the form of annual reports from the competition authorities of 32 Member and observer countries. (In this paper “merger” includes “acquisition” and “concentration,” as those terms are customarily used to denote business combinations.) The reports, which were submitted in the spring and fall of 1999, cover roughly the period 1998 and the first half of 1999, although the relevant periods vary slightly from country to country. The reports typically contain the following types of information relating to merger control: recent changes to relevant laws and regulations; statistics describing merger enforcement activity; and brief descriptions of recent significant merger investigations and cases.
