Computer programs are literary works, and as such they are protected under the German Copyright Act, § 69a. From this copyright protection it follows that both the use of computer programs and the transfer of use rights require permission. This paper aims to analyze the possibilities of a transfer of use rights from a licensee of a computer program to a third party.

Computerprogramme im Sinne des § 69a UrhG sind urheberrechtlich geschützte Sprachwerke. Daher bedarf nicht nur die Benutzung von Computerprogrammen der Erlaubnis, sondern auch deren Weitergabe muss gestattet sein. In diesem Beitrag werden die Möglichkeiten der Übertragung von Nutzungsrechten an Computerprogrammen durch einen Lizenznehmer an einen Dritten untersucht. Dabei erfolgt keine erschöpfende Darstellung und Entscheidung sämtlicher Erwägungen und Streitfragen, sondern vielmehr eine grundlegende Analyse ausgewählter Aspekte der geltenden Rechtslage.
