Abstract:

The legal basis for the actions of the European Commission in the field of transport of nuclear materials has its origin both in the EC and the EURATOM Treaties. While recommendations on the transport of radioactive materials are drawn up by the IAEA in Vienna and transposed into the national legislation of each country, the European Community must ensure that these provisions are in conformity with its own requirements and that they facilitate the functioning of the internal market. To advise the Commission on issues related to the transport of radioactive materials, a standing working group was established in 1982. The Commission also helps in gathering information by financing studies on various aspects such as surveys of legislation or of events or investigations related to technical matters.
