Abstract:

Competition law provides the rules of the market economy game: with competition as the basis for a market economy, competition law ensures that it can take place. Competition law is general agnostic as to the outcomes of that game. That may come under pressure in times of economic pressure, when governments seek to procure particular economic or social outcomes. History suggests that this may be a good explanation for recent moves towards procuring particular outcomes from the competitive process rather than merely policing competition rules; it does not seem right to suggest that those moves indicate any wider discontent with the competitive process or with competition law as an effective tool.
