Certainty Versus Uniformity: Renvoi in the Context of Movable Property

Abstract:This article considers the issue of renvoi as it arose in the case of Blue Sky One Ltd & Ors v Mahan Air & Anor  EWHC 631. It argues that the rejection of renvoi in this case has made the use of aircraft as security for loans more difficult. It also argues that the achievement of uniformity of decision should have weighed more heavily than certainty in the law with the judge.
