Abstract:

The Court of Appeal recently allowed Dr Singh's appeal in an important libel case. For the Court of Appeal, his criticism of the British Chiropractors' Association (there is 'not a jot of evidence' for the efficacy of its treatments) amounted to comment, rather than allegations of fact. But in its understandable concern to allow the appeal, the court may not have done justice to the claimant's argument that Singh's article accused the Association of recklessness in its peddling of its treatments. The Court of Appeal may have significantly expanded the scope of the fair comment defence.
