Abstract:
The case of Benjamin Feld, Larry Feld, and Judith Feld v. Luke Borkowski shows that getting hit with a bat is not necessarily an inherent risk in softball. While sport providers have a duty to inform individuals of the inherent risks of participation, individuals should be aware that inherent risks of participation are not an unlimited defense for all conduct during contact sports; participants still have a duty not to engage in reckless or dangerous conduct, and they can be deemed legally liable for their actions.Document Type: Miscellaneous
